The Delhi High Court has denied anticipatory bail to a man accused of falsifying his identity and marrying a woman, while he was already married.
The court of Justice Hima Kohli dismissed the plea for anticipatory bail filed by Kushal alias Ahmad, whose wife had filed a an FIR for rape and cheating in September after finding out that he belonged to a different religion and was married to another woman.
According to the allegations raised in the FIR, the woman and Kushal had eloped and married in court earlier this year. At the time, Kushal had filed an affidavit stating that he was unmarried.
After the wedding, the woman found that he had not only concealed his marital status but had also lied about his religion. She claimed she had found that out through a ration card at their residence. On the card, Kaushal was registered under a Muslim name and was shown to be married.
The accused had claimed that the woman had been aware of his religion before marriage. However, the court dismissed his plea after noting that he had not cooperated with the investigation and had also not returned the articles belonging to the complainant.
