Maintain status quo on waste management draft, says HC

A Karnataka High Court Bench has asked the Ministry of Environment and Forests (MoEF) to maintain status quo on a draft of the Municipal Solid Waste (Management and Handling) Rules, 2013 that is currently being circulated ahead of notification.

The Bench, ordering the status quo on the draft rules said the draft seemed to be an attempt to reverse the new segregation-based system that is being put in place. The Bench, comprising Justice N Kumar and Justice B V Nagarathna passed the ruling based on a PIL which stated that the proposed draft would set back efforts taken in the past nine months. It has sought the Centreís response on the draft rules which include clauses existing in the Municipal Solid Waste (Management and Handling) Rules, 2000, that was framed on a SC direction.

The MOEF issued a draft of the Municipal Solid Waste (Management and Handling) Rules, 2013 on July 2 and called for objections within 60 days beginning August 29, 2013.

The fact that the MoEF was circulating the draft was brought to the notice of the HC on Friday and it was pointed out that the draft rules were contrary to the ongoing measures, since it does not prioritise waste segregation but like the 2000 Rules puts the onus on garbage collection and storage by municipalities before segregation.
