According to FICCI, there should not be any linkage of patenting of software having technical affect with the novelty of hardware. The open source community will not have anything to do with software patents in their entirety. “Open source software is one of the most dynamic, innovative sectors of the global economy, but the patient system is a costly hindrance to open source,” said Hariharan of Red Hat....

Patents are illegal as they infringe on social ownership of knowledge. India, with its rich cultural heritage of 'giving' to the world, must oppose all such moves for patenting knowledge. Unless ofcourse we want to have patents for Ramayan, Mahabharat, Gita, Basmati, Haldi etc.

Obviously Sudhir does not understand the patent regime. Patents encourage technological development and contribute to the enhancement of knowledge. Patents are good for Society as a whole. Obviously, something that is already known in prior at cannot be patented. For example, in the Ramayana, Garuda is used a flying vehicle, but does that infringe on the airplance that was invented. Obviously NOT, for a whole lot of reasons. Also remember that 99% of the inventions are really improvements over what is already known and only about 1% are real breakthrough ivnentions.

Obviously, Eric does not understand the patent regime. Software patents and ideas are patently different from designing flying vehicles. And patenting flying vehicles would need another discussion forum of its own.
