Housing creating marital discord in young low-income couples, do something, says HC to govt

moved the high court in 2010 against a lower court decision to not grant him the divorce. He alleged his spouse had left the matrimonial home several times in past.

The court trashed his plea, saying the ground of cruelty did not sustain as they cohabited thereafter and were also blessed with a baby girl.

Instead of bothering about the welfare state in India, Court could devote itself for interpretation of statutes for settlement of disputes; at the same time, judicial authorities could devote themselves in finding workable solutions of twin problems relating to-- (a) long pending cases; and (b) corruption among judges and administrative staff of the courts

Now a days, judicial authorities, which are expected to interpret the laws for settlement of disputes, have been advising the Government on social issues, without taking into account other circumstances. In this particular case, Court does not seem to have taken into account apparent problem of population explosion in India.The Court does not seem to appreciate that in spite of population growth, Government has been trying to resolve the issue under Indira Awas Yojana,etc.
