HC allows ABG to withdraw its cranes from Haldia dock

The Calcutta High Court on Thursday allowed the ABG Shipyard to remove cranes and other equipment from berth numbers 2 and 8 of Haldia dock complex of Kolkata Port Trust (KoPT). Justice Sanjib Banerjee appointed two special officers to oversee the removal of machinery. The court directed ABG to remove the cranes within six weeks and other machinery, including dumpers and vehicles, within two weeks. The KoPT had moved the High Court asking it to not allow the ABG to remove its machinery till the settlement of dispute between the two on the termination of the signed agreement. It had claimed that stoppage of cargo-handling operations by the ABG had led to huge financial losses for the KoPT and that the company had committed breach of contract by doing so.
Justice Banerjee, however, rejected the KoPT’s plea.
Manish Jain, chairman of the KoPT, said that it would challenge the order on the Division Bench.
