Los Angeles: Teen star Miley Cyrus has been given a clean chit in a court case over an alleged racially insensitive photo she posed for earlier this year.

The judge has thrown out a USD 4 billion lawsuit filed against her by a member of the Asian community here.

The 'Hannah Montana' star was sued by Lucie Kim on behalf of LA's Asian citizens after a picture of the singer and her pals making a "slanty eyes" gesture surfaced online in February, celebrity website TMZ.com reported.

Kim claimed the photo showed Cyrus and her friends mocking the Asians and insisted that she was emotionally stressed after viewing the snap.

Cyrus later apologised but Kim pressed ahead with plans to file suit.

During a hearing in June, Los Angeles Superior Court Judge Robert Hess claimed Cyrus' behaviour was "immature and childish", but added that he had "grave doubts" Kim would be able to prove her contention that the singer is a "business establishment" and therefore obliged not to act in such a manner publicly.

Kim lost her bid for compensation from the 17-year-old on Friday when Hess dismissed the case altogether. She is considering appealing the ruling.

the ruling was bull crap! just because she is a so-called celebrity doesnt mean she shouldnt pay for the stupidity and idioticness that she caused> i wish miley WAS on that bus that way she would be out of everyone's hair

WOW whatever, she needs to back off of Miley. Its obvious she meant no harm by taking those photos and even APOLOGIZED on top of that. This lady is just out for money, so that she won't have to work to pay her bills. She lost one time, she might as well give up. Its over Kim, move on with your life.
