Austrian Airlines was on Friday asked by a consumer forum here to pay Rs 75,000 as damages to a flier for his harassment due to cancellation of his flight from Vienna to Delhi, forcing him to take the next day's flight.

The New Delhi District Consumer Disputes Redressal Forum ordered payment of damages to Delhi resident Madhukar Goyal on his complaint against cancellation of the flight.

“We have heard parties. Keeping in view the circumstances and admission by opposite party 1 (Austrian Airlines) we award Rs 75,000 as damages which include harassment and litigation expenses to be paid by opposite party 1,” the Bench presided by C K Chaturvedi said.

Goyal in his complaint had said he had booked a business class ticket on Austrian Airlines to return from Vienna to New Delhi on June 16, 2007.

On reaching the airport he found that his flight had been cancelled, he said adding thereafter he was booked in economy class on next day's flight.

Goyal had said Austrian Airlines did not return the difference of fare between his business class ticket in the cancelled flight and the economy class ticket booked later.

He also alleged “discrimination” by the airline saying he was not allowed to travel by first class while a woman who had come later was allowed to do so.

In its reply to the complaint by Goyal, the airline had admitted that the scheduled flight was cancelled and he was booked on another flight the next day, but it denied having discriminated against him.
