New Delhi, April 13:: United Airlines has been directed by the Delhi Consumer Commission to pay Rs 50,000 to an exporter whose dream of displaying some handicraft items at a trade fair in Mexico city turned sour due to delayed delivery of baggage.

Allowing a complaint of A P Sharma, proprietor of Anigh Export International, President of the Commission Justice J D Kapoor also directed the airlines to pay Rs 10,000 to him as cost of litigation.

"Even though there was no term of contract between the parties in case of late delivery, the airlines shall be liable to compensate the passenger in terms of the value of the bag but it does not mean that the service provider is not liable to compensate the consumer at all, if it is found to be guilty for deficiency in service," the Commission said.

Sharma, engaged in business of export of herbal and handicraft products, was to participate in the trade fair in Mexico City from March three to nine, 1998.

But he found that one of his baggages containing some handicraft products could only be delivered to him three days after the fair was over.

In his complaint before the Commission, Sharma sought a compensation of over 40,000 USD for loss of business, mental agony and inconvenience.

The airlines, however, contended that though only one baggage of the complainant was delayed, it was delivered to him on March 12, 1998. Referring to the Warsaw Convention, the airlines claimed that its liability was limited to the terms printed on the ticket jacket.
