New Delhi: Satyam Infoway Ltd has got a major relief in its Internet business as the Supreme Court has set aside a Delhi High Court order allowing another company to use a domain name deceptively similar to its website www.sify.com.
Setting aside a High Court order allowing Siffynet Solutions Pvt Ltd to carry on its business with domain names like www.siffynet.com, a bench comprising Justice Ruma Pal and Justice P V Reddi said Siffynet Solutions can continue its business by changing its domain name.
Holding that “Internet domain names are subject to the legal norms applicable to other intellectual properties such as trademarks”, the bench said Satyam was the prior user and has the right to debar Siffynet Solutions from eating into the goodwill it has built up in connection with www.sify.com.
Satyam said that it had been using the domain name from 1999 as compared to rivals coming to the picture in 2001 and claimed that it has more than five lakh subscribers, 840 cyber cafes and 54 points of presence all over India.
