CERC notice to Rajasthan for denying open access

New Delhi, Sep 5: Taking a stern view of the denial of an open access by state load despatch centres, the Central Electricity regulatory Commission (CERC) has issued show cause notices to Rajasthan state load despatch centre (SLDC) and Rajasthan Rajya Vidyut Prasaran Nigam (RRVPNL) to explain why no action should be taken against them for violating CERC’s regulations on open access in inter-state transmission.

The complaint was filed by Gujarat Flurochemicals, a company that owns wind generation facility in Jaisalmer, district of Rajasthan. In order to compensate Gujarat Flurochemicals commercial losses caused due to unfair and illegal action, CERC has directed that Gujarat Flurochemicals be paid for wind power, which was drawn by Rajasthan power utilities, at the rate specified by CERC for wind generation. CERC observed that the objection on the basis of which open access was denied were not germane to the issue at hand and held that action of RRVPNL was unfair and illegal. CERC said that such action appears to be an attempt to create a situation whereby Gujarat Flurochemicals is focused to sell its output within the state, which is against the intent and content of the Electricity Act, 2003.

The CERC regulations require SLDC concerned to give its decision on such application within three working days. In case of refusal, reasons for the same are also to be given by SLDC within three working days. CERC prima facies found that Rajasthan SLDC and RRVPNL, which operates third SLDC have failed to comply with the requirements of CERC regulations. CERC has emphasised that load despatch centres being statutory bodies under the Electricity Act are bound to consider the applications for open access in an impartial manner and in line with the spirit and the express provisions of the Electricity Act and the open access regulations without being influenced by the views of any other utility.
