Even after completion of his life sentence, Ganga Sahni is rotting in Burail Jail. Reason: there is none to furnish a surety bond for him. It was on July 24 this year that the UT Administrator finally decided his representation demanding premature release.
Imprisoned for life (14 years) on charges of murder, Sahni has been languishing behind bars for the past 16 years two months now. Sahni had submitted a representation two years back requesting premature release. The Administration finally decided that Sahni, a daily wager, should be released but much to his regret he has no family member who can submit a surety bond.
There are seven more such convicts in Burail Jail who even after completion of their life sentence are languishing behind bars awaiting response to their representations demanding premature release. Majority of them had written to the Chandigarh Administration in 2011 but the representations are yet to be decided. This was told to the Punjab and Haryana High Court on Wednesday by the Chandigarh Administration during the resumed hearing of a petition concerning premature release of such convicts.
Advocate Navkiran Singh, who was assisting the court in the case, requested the court to direct the Administartion to release Sahni on a personal bond. When asked about this by the Court, counsel for Chandigarh Administration submitted that the search is on to locate family members or friend of Sahni, who hails from Uttar Pradesh.
So that the representations of other seven convicts are decided without any delay, the high court on Wednesday directed the Administration to submit as to in how much time their representations will be decided.
The court also asked the Administration to come up with a policy wherein a deadline can be stipulated in such cases within which the concerned authority has to decide the representation of a life convict seeking premature release. Also, the fate of their representations need to be conveyed to the convicts, the court remarked, within the said deadline.
The Counsel for Administration was on Wednesday asked to take instructions from the authorities regarding the deadline.
