The Supreme Court on Thursday indicated that it might ask the Special Public Prosecutor (SPP) to take the final call if Bharti Airtel chairman Sunil Bharti Mittal should be chargesheeted for his alleged role in a case relating to the 2G spectrum allocation.

A Bench of Justices G S Singhvi and K S Radhakrishnan said that it would examine the issue and pass proper orders after the CBI submitted that there was a difference of opinion between their investigation and prosecution wings over filing a chargesheet and naming Mittal as an accused in the FIR.

The FIR, which had also named other companies besides Bharti Airtel, was filed in connection with alleged irregularities in grant of spectrum during the tenure of the late Pramod Mahajan during the NDA regime. After the Director of Prosecution, which was sent the CBIís draft chargesheet for its opinion, noted that no criminal case was made out, the CBI had referred the matter to Attorney General G E Vahanvati.
