Wipro Consumer Care and Lighting on Tuesday said that a Hyderabad court has restrained food company Heinz India from manufacturing and marketing a brand of energy tablets that was allegedly similar to the Glucovita Bolts brand sold by Wipro.
Heinz, known for its brand of tomato ketchup, is the maker of Glucon D glucose powder. Wipro moved court when Heinz launched a product branded Glucon D Volt in January 2015, which it claimed, was similar to the Glucovita Bolts that Wipro has been selling since 2012.
“Apart from the similar sounding brand name, Heinz has also used key elements of communication, colour scheme, getup and tag line ‘energy anytime anywhere’ from the packaging of Glucovita Bolts,” said a release from Wipro Consumer Care. “We have initiated action against Heinz India to protect our brand and consumer interest,” said Anil Chugh, Consumer Care Business CEO, Wipro.
“The city civil court at Hyderabad has awarded an ex-parte, ad-interim injunction, restraining Heinz India from manufacturing, marketing, distributing, offering or advertising for sale Heinz’s product as it was seen deceptively similar to Glucovita Bolts,” the release said.
