Supreme Court seeks Vodafone response on Aircel appeal over SMS charges

The Supreme Court on Friday sought response from Vodafone on Aircel’s appeal against fixation of SMS termination charges at the rate of 10 paise per SMS in respect of Interconnect Agreements by the sectoral tribunal.

A bench headed by Justice Kurian Joseph also tagged the case with couple of other similar pleas filed by Reliance Telecom and Tata Teleservices. The companies have challenged a part of the TDSAT judgment that held that Interconnect Usage Charges for SMS Termination was payable at the rate of 10 paise per SMS in respect of Interconnect Agreements.

The cases will be heard next in September.

Earlier, the bench had sought response from Bharti Airtel and Idea Cellular on an appeal by Reliance Communications (Rcom), which argued that fixing of SMS termination charges was “contrary to the Regime of “Bill and Keep” which was followed by all telecom operators at that time (2012).

Under the “Bill and Keep” regime, the telecom operators neither raised bills on each other nor was any payment made towards SMS Termination,” RCom said.
