Supreme Court issues contempt notice to justice Markandey Katju on his blog against the apex court

The Supreme court of India on Friday issued notice of contempt to it's foremer jusdge and justice Markandey Katju who had earlier crticised the apex court on the jusdgement of Soumya rape case.

The Supreme court of India on Friday issued notice of contempt to it’s foremer jusdge and justice Markandey Katju who had earlier crticised the apex court on the jusdgement of Soumya rape case. The introductory lines of his official blog says, ” I have now read the judgment of the Supreme Court in the Soumya case ( Govindachamy vs. State of Kerala ).. I have found it incorrect so far as it finds Govindachamy not guilty of murder but only guilty of rape.. Let me give my reasons.”

Justice Katju goes on to mention that, “The Supreme Court has found the accused not guilty of murder and so has set aside the death sentence awarded to him. However, it has upheld the life sentence for rape under section 376, and imposed punishment of 7 years imprisonment.under section 325.

In acquitting the accused on the murder charge the Court held that there is no evidence that the accused had any intention of causing the death of Soumya.
and so could not be convicted under section 302 I.P.C. The Court held that it is possible that after being assaulted on the head 4 or 5 times and then raped Soumya might herself have jumped off the train on which she was travelling. However the Court found the accused guilty of rape under section 376 and also guilty of some other provisions of the IPC.”

In reaction the Supreme Court has said that the language used by Justice Katju inhis blog was unacceptable for the judges and not the judge, hence a contempt notice has been issued.

Justice Katju has said that the language used by the the judges looked more like a threat. As per reports the Supreme court has rejected a review petition by the Kerala government and rape victim Soumaya’s mother challanging convict’s acquittal from murder charge.
