The Supreme Court on Friday agreed to hear Gujarat government plea on August 22 against High Court order quashing ordinance of 10% quota for economically backward among unreserved category. The Gujarat government in April, had announced a 10% quota for all members of economically backward classes, including those belonging to the upper caste. The decision, that was taken under Anandiben Patel’s government, didn’t seem to have bright prospects given an existing 49% reservation for SC, ST and OBC against a maximum 50% reservation.
The Gujarat HC recently issued notice to state government on a petition challenging the ordinance prescribing 10 per cent reservation for the economically backward classes (EBC) among upper castes. The petition alleges that the special provision for reservation is “contrary to fundamental rights”. The vacation bench of Justice Paresh Upadhyay issued notices to the secretaries of Legislative and Parliamentary Affairs department, Education department and General Administrative department, and posted the matter for further hearing on June 22. The petition has sought a stay on the implementation of the ordinance immediately.
