On Tuesday, following a Bombay High Court direction to demolish its building, Adarsh Housing Society had moved the Supreme Court. SC now has directed central government to take possession of the 31-storey building, located in a sensitive Army area at Colaba, and to secure the building. SC finally intervened after the society lost a environment zone violations case and had an order of demolition which the Ministry of environment and forests (MoEF) had issued. Nevertheless, the HC had given a 12-week stay on that order, even after MoEF detailed many ‘serious breaches of law’. The society in turn had pointed out that MoEF to issue the order had allegedly “shortcircuited’ natural justice. The finding of the High Court was also challenged by the society. After the order Solicitor General Ranjit Kumar has told SC “We will secure the building and there will be no demolition.”

The Adrash scam broke in the 2010, Ashok Chavan allegedly had three relatives who were alloted flats in the society, and hence had to resign. It was also found that 25 flats were given to people who were ineligible and 22 sold with wrong names. This order comes at a time when Army has formed a court of inquiry and investigation of the role for former General Officers Commanding of Maharashtra, Gujarat and Goa Area (MG&G Area) in the Adarsh scam after Bombay HC’s direction. The handing over of possession has to be done on or before August 5. The process will be supervised by Registrar General of Bombay HC or by his nominee Registrar, PTI reported.
