extends bar on Lucknow firm using KBC-like logo
New Delhi, Aug 21: The Delhi High Court on Tuesday
extended the order restraining the Lucknow-based Networld
Infoservices from using an identical “circular logo” and the
feature “money tree” of the programme Kaun Banega Crorepati
on its website to run a similar game show.
Justice VS Aggarwal in an ex-parte order extended the injunction
granted in favour of UK-based Celador Productions Ltd, producer
of the game show “Who Wants To be a Millionaire,” which had
given licence to Star TV to produce the game show under the
name Kaun Banega Crorepati, popularly known as KBC.
Directing Networld Infoservices to file a reply by September
14, the court said “till then the defendants (Networld) are
restrained from using the circular logo and money tree used
by the makers of KBC in their website www.crorepatikaun.com”.
Celador’s counsel Man Mohan Singh had alleged that the Lucknow-based
company was using the circular logo, money tree, lifeline
and other pictures of KBC in their website in violation of
the intellectual property rights bestowed with the UK company.
The court had earlier issued notice to Networld Infoservices
on August 7 restraining it from using the circular device
and money tree and had said order on other grievances of KBC
would be decided after hearing the concerned parties.
Alleging that the Lucknow-based company was causing confusion
to consumers by passing its business as that of KBC, Singh
said Networld Infoservices had adopted and used the domain
name “crorepatikaun.com” with dishonest and malafide intention.
The UK-based company had said that Networld Infoservices had
reproduced the events and screen shots of various episodes
of Celador’s original game show and were inviting the people
to play the game KBC online. (PTI)
