New Delhi: The government on Friday introduced in Parliament the Cable Television Network (Regulation) Amendment Bill, 2000, to amend the existing cable laws.The amendment, if passed by Parliament, proposes that all free-to-air satellite channels will come under the ambit of the existing programme and advertising code. The amendment also makes it mandatory on cable operators to re-transmit at least two Doordarshan terrestrial channels (DD I and DD II) and one regional language channel in the prime band.
The amendment has empowered the district magistrate, sub-divisional magistrate and a commissioner of Police as "authorised officer" for effective enforcement of the Act. Moreover, any officer authorised by the government can act to enforce the Act. The Central and state governments are empowered to notify additional authorised officers.
If the cable operator contravenes the Act "authorised officer" have the power to seize the equipment being used by the cable operator. The authorised officers are empowered to prohibit any programme or channel if it is not in conformity with the prescribed programme and advertising codes.
To have more control over "rogue" channels beaming into the country the amendment proposes to regulate or prohibit the transmission of any channel or programme if it is necessary to do in the interest of the "sovereignty or integrity of India or security of India or friendly relations of India with any foreign state or public order, decency or morality." The amendment proposes to empower the Prasar Bharati to specify by notification the number and name of the Doordarshan channel to be re-transmitted by the cable operators and the also the manner of reception and retransmission of such channels.
