Housing creating marital discord in young low-income couples, do something, says HC to govt

Costly living coupled with poor housing facilities are creating marital discord among young low-income couples, the Delhi High Court has said while asking the city government to "seriously" consider augmenting public housing in the national capital.

"The city of Delhi is a costly place to live. Family budgeting and especially when a child is born is becoming a herculean task even for the financially well-off and even they come under financial stress and the same burdens and causes stress on the matrimonial bond," a bench of justices Pradeep Nandrajog and Pratibha Rani said.

The observations were made by the court while dismissing an appeal of a man against the judgement of a family court which had rejected his plea to seek divorce from his estranged wife on the ground of cruelty.

The court said the "failing welfare state" and "rampant unauthorised colonisation" were forcing "unfortunate people" to live in "hell holes".

"It saddens us to see the unfortunate young couple becoming victim of circumstances beyond their control and the judicial system looking on helplessly, because the failing is by the State. A good clean environment with a cozy small house would go a long way to soothe the roused tempers and feelings.

It is only the State which can provide said environment.

"Perhaps, at least in the city of Delhi, the government needs to seriously consider augmenting public housing with emphasis on sanitation," it said.

Rejecting the divorce plea, it said persons with "improved moral condition" were better equipped to cope with the stresses.

The man had moved the high court in 2010 against a lower court decision to not grant him the divorce. He alleged his spouse had left the matrimonial home several times in past.

The court trashed his plea, saying the ground of cruelty did not sustain as they cohabited thereafter and were also blessed with a baby girl.
